1. Acceptance of Terms

By downloading, installing, or using Dawn ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Dawn is a voice-powered journaling app that allows you to record, transcribe, and reflect on journal entries using AI-assisted features. The App is available on iOS with optional subscription features.

3. Account Registration

You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Subscription Terms

Pricing & Billing

• Dawn offers free and premium subscription tiers.
• Subscriptions are billed through Apple's App Store and managed by Apple's payment infrastructure.
• Prices are displayed in the App prior to purchase.

Free Trials

• If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial period ends.

Cancellation & Refunds

• You may cancel your subscription at any time through your Apple ID settings.
• Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple in accordance with their refund policies.

Changes to Pricing

• We may change subscription pricing with reasonable notice. Price changes will not affect your current billing period.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's services or servers
• Upload malicious content or attempt to exploit the AI features
• Use the App to generate content that is harmful, abusive, or violates the rights of others
• Share your account credentials with others or allow unauthorized access

6. Intellectual Property

Your Content

• You own your content. All journal entries, voice recordings, and personal data you create in Dawn remain your intellectual property.
• You grant Big Water LLC a limited license to process your content solely for the purpose of providing the App's features (e.g., transcription, AI analysis).

Our Property

• The App, its design, code, branding, and AI features are the intellectual property of Big Water LLC.
• These Terms do not grant you any rights to our trademarks, logos, or brand assets.

7. AI-Generated Content

• The App uses speech recognition to generate transcriptions and AI to generate summaries, chat responses, search, and suggestions based on your entries.
• AI-generated content is provided "as-is" and should not be considered professional advice (medical, legal, psychological, or otherwise).
• You are responsible for how you use or rely on AI-generated content.

8. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the data practices described therein.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Transcriptions or AI-generated analyses will be accurate or complete
• The App will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG WATER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF YOUR USE OF THE APP.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Big Water LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

• You may stop using the App at any time by deleting it from your device.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your right to use the App ceases. Sections that by their nature should survive (Intellectual Property, Limitation of Liability, Indemnification) will survive termination.

13. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes shall be resolved in the courts of York County, South Carolina.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.
